This matter is taken up through hybrid mode.

This writ petition has been filed by the Petitioner seeking a direction to the Opposite Party No.3 to recover the loan amount from him, if any, with due process of law sanctioned for the purchase of the tractor bearing registration No.OR-04-B-4879 and the trailer bearing registration No.OR04-B-4880 with further direction to the Opposite Party No.4O.I.C., Sukinda to take appropriate legal action against the Opposite Party No.2 for forcibly taking out the aforesaid tractor and trailer from his lawful possession.

No one appears on behalf of the Petitioner at the time of call. However, learned counsel for the StateOpposite Party No.4 is present. 4.

The case is of the year 2005.

As such, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter.
