1. This petition by the Kendriya Vidyalaya Sangathana, questions an order dated 5th February 2004, passed by the Central Administrative Tribunal, Cuttack Bench, Cuttack (CAT) in T.A. No.4 of 2001 by which the CAT directed reinstatement of the Opposite Party as probationer granting liberty to the present Petitioner to recommence the proceedings against the Opposite Party in accordance with law. By an order dated 3rd March 2005, the impugned order of the CAT was stayed and that order has continued since. The Opposite Party was 45 years old in 2005 and today he has crossed the age of superannuation. Consequently, the impugned order of the CAT is incapable of being implemented.

2. Consequently, the Court feels no necessity of examining the correctness of the impugned order. Accordingly, the writ petition is disposed of.
