1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.

2. Heard Mr. Roy, learned counsel for the Appellant.

3. Even though this appeal was filed on 20.09.2002 challenging the order dtd.04.05.2002 passed in MJC No.77 of 1999 by the learned District Judge, Ganjam-Gajapati, but till date no notice has either been issued in the appeal or even on the Petition filed for condonation of delay. This Court after going through the grounds taken in the Petition seeking condonation of delay, did not find the same convincing at all. Accordingly, this Court is not inclined to condone the delay in filing the appeal.

4. Accordingly, Misc. case is hereby rejected. Consequentially, FAO is also dismissed.
