This matter is taken up through video conferencing mode.

Heard learned counsel for the petitioners and learned counsel for the State.

This is an application under section 438, Cr.P.C. for grant of anticipatory bail to the petitioners in connection with Thelkoloi P.S. Case No.68 of 2009 corresponding to C.T. Case No. 1632 (A) of 2009 pending in the Court of learned S.D.J.M., Sambalpur for alleged commission of offence under section 397 of

// 2 // the Indian Penal Code.

Perused the F.I.R. annexed to the anticipatory bail application.

Since it is a case of the year 2009 and the petitioners have approached this Court more than twelve years after lodging of the F.I.R., while not inclining to grant anticipatory bail to the petitioners, liberty is granted to the petitioners to surrender and move for bail in the Court below within a period of four weeks, in the event of which the learned Court below shall dispose of the same in accordance with law expeditiously and the claim of parity with the coaccused, who is stated to have been released on bail, shall be taken into account. The case records shall be made available to the Court concerned for disposal of the bail application.

The ABLAPL stands disposed of.
