1. The Petitioner is a subsequent purchaser from a lessee whose lease has been cancelled by the impugned order dated 4th November, 2004 by the Additional Tahasildar, Bhubaneswar in W.L. Case No.915/72.

2. The above impugned order was passed without notice to the Petitioner. Accordingly, the impugned order dated 4th November 2004 is hereby set aside and the W.L. Case No.915/72 is restored to the file of Additional Tahasildar, Bhubaneswar for being proceeded with in accordance with law and for a fresh order to be passed after hearing the parties. The Petitioner will appear before the Additional Tahasildar along with downloaded copy of this order on 16th May, 2022. The fresh order will be passed within a period of four months thereafter.

3. The writ petition is disposed of in the above terms.
