This matter is taken up through Video Conferencing mode. 2.

The limited grievance of the Petitioner is that in view of Para5 of the Government guidelines dated 4th October, 2018, the Petitioner has preferred an appeal before the Director, Elementary Education, Opposite Party No.2. It is stated that the Petitioner has filed an appeal before the Director, Elementary Education, Odisha which is pending before him.

3, Learned counsel for the Petitioner prays for a direction to the appellate authority to dispose of the appeal within a stipulated period of time. Since the issue involves in the appeal relates to transfer of the present Petitioner, this Court thinks it proper to direct the appellate authority to consider the matter at the earliest. 4.

Mr.Jena, learned Standing Counsel for School & Mass Education Department has no objection if a direction is given to the appellate authority to dispose of the appeal within a stipulated period

After hearing the learned counsel for the parties, this Court dispose of the writ application with a direction to the Director Elementary Education to dispose of the pending appeal under Annexure-8 within a period of four weeks from the date of production of authenticated copy of this order by a speaking and reasoned order. Any decision so taken in the appeal shall be communicated to the Petitioner within one week thereafter. 6.

With the aforesaid observation, the writ application stands disposed of.

As the restrictions due to resurgence of COVID -19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020, modified by Court's Notice No.4798, dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
