Heard Mr. S.C.Puspalaka, learned counsel for the petitioners and Mr.

R.P.Mohapatra, learned Additional Government Advocate through video conferencing mode. 2.

According to Mr. Puspalaka, the petitioners, who are the residents of Mahavir Nagar Basti, Gadakana, Bhubaneswar are aggrieved by inaction of the authorities in not extending them the benefits under Prime Minister Awas Yojana, though they are eligible for the same as per the terms and conditions of the Scheme. During course of hearing, he submits that liberty may be granted to the petitioners to approach the Bhubaneswar Municipal Corporation represented through the Commissioner (opposite party no.3) for redressal of their grievances and the said opposite party be directed to take a decision on such grievance petition within a specific time period and in the interregnum, interests of the petitioners be protected as otherwise they may be evicted.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioners to approach the Bhubaneswar Municipal Corporation represented through the Commissioner (opposite party no.3) by filing grievance petition along with the copy of this order through Registered Post within a period of ten days from today. In the event, such grievance petition is received by opposite party no.3, the said opposite party is directed to take a decision on the same in accordance with law within a period of three weeks from the date of receipt of such grievance petition and communicate the result of such exercise to the petitioners. Till disposal of such grievance petition, no coercive action shall be taken against the petitioners.

Accordingly, the writ petition is disposed of. 5.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No. 4587, dated 25th march, 2020, modified by Notice No. 4798, dated 15th April, 2021, and Court's Office Order circulated vide memo Nos. 514 and 515 dated 7th January, 2022.
