Amit Ku.Sar v. State And ORS.
IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P.(C) No.1034 of 2013 Amit Kumar Sar ....
Petitioner Mr. S.P. Misra, Senior Advocate -versusState of Odisha and others ....
Opp. Parties Mr. D.K. Mohanty, AGA
CORAM:
THE CHIEF JUSTICE JUSTICE R.K. PATTANAIK Order No.
ORDER
10.08.2022 07.
1. The only doubt was whether Annexure-2 being a letter dated 26th July, 1991 written by the Petitioner to the Director of Estate about the change of address, had been received by the Director of Estate or not. While the Petitioner asserted that it had been delivered, in the counter affidavit it was denied by the State.
2. This Court had directed the original record to be produced to ascertain if indeed the letter had been received by the State. The Court has perused the original record and finds there is no such letter in the record of the State.
3. In that view of the matter, the status quo order passed on 21st January, 2013 is vacated. The writ petition is dismissed. No order as to costs.
