This matter is taken up through hybrid mode.

This RPFAM has been filed assailing the judgment and order dated 15th November, 2010 passed by learned Judge, Family Court, Baalsore in Crl. Proceeding No.192 of 2010 (Misc. Case No. 270 of 2008).

On perusal of the order sheet, it appears that pursuant to the direction of this Court dated 26th March, 2012, although defects were removed, but the Petitioner has not taken any step in the matter for last ten years.

Learned counsel for the Petitioner prays for an adjournment stating that file has been misplaced.

In view of the fact that the impugned order was passed on 15th November, 2010, i.e. almost twelve years back and no step has yet been taken to move the application for condonation of delay of 414 days in filing the RPFAM, I am not inclined to entertain the prayer made by learned counsel for the Petitioner.

Accordingly, the RPFAM is dismissed for non-prosecution. (K.R. Mohapatra) bks Judge
