This RPFAM has been filed assailing the interim order of maintenance dated 8th August, 2008, passed in Criminal Proceeding No.232 of 2005, whereby by learned Judge, Family Court, Cuttack, as an interim measure, directed the Petitioner to pay maintenance at the rate of Rs.800/- per month to Opposite Parties.

Order sheet of the RPFAM reveals that vide order dated 19th December, 2008, this Court directed issuance of notice to Opposite Parties. Although notice was made sufficient on the Opposite Parties, but none has yet entered appearance. Thus, it appears that the parties are not interested to pursue the matter. 5.

Accordingly, the RPFAM is dismissed for nonprosecution. 6.

Interim order dated 19th December, 2008 passed in Misc. Case No.30 of 2008 stands vacated.
