This matter is taken up through Hybrid Arrangement (Video Conferencing/Physical Mode). Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State as well as learned counsel for the informant.
This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Nandankanan P.S. Case No.149 of 2021 corresponding to G.R. Case No.1165 of 2021 pending in the Court of learned S.D.J.M., Bhubaneswar for alleged commission of offences under sections 341/325/379 of the Indian Penal Code.
// 2 // Learned counsel for the State has produced the injury report of one Pravat Kumar Pradhan which shows that the injured has sustained fracture in right ankle which has been opined to be grievous in nature.
Learned counsel for the informant submitted that the case has turned to one under section 307 of the Indian Penal Code.
Considering the submissions made by learned counsel for the respective parties, the nature of accusation and the injury sustained by the injured, while not inclining to release the petitioner on anticipatory bail, it is ordered that in the event the petitioner surrenders and moves for bail before the learned Court below within a period of four weeks from today, the same shall be disposed of as expeditiously as possible by the Courts below and if any co-accused has been released on bail in the meantime, the claim of parity shall be taken into account. The case records be made available before the Courts concerned for adjudication of the bail application.
The ABLAPL stands disposed of.
