This appeal has been filed by the Appellant challenging the order dated 28.07.2003 passed in M.J.C. No.29/2001 by the learned Civil Judge(Senior Division), Sonepur in rejecting an application filed by the Appellant under Order-9, Rule-9 of C.P.C. 4.

Even though the appeal has been filed in the year 2003, but till date no notice has been issued.

Be that as it may, nobody is there to place this matter. 6.
