1. Heard Mr. D. Sethy, learned counsel for the Petitioner as well as Ms. S. Mishra, learned A.S.C. for the State-Opposite Party.
2. The Petitioner is the accused in 2(a)(C)(C) No.70/2020 being the owner of the vehicle for alleged offence under Sec.52(a) of Orissa Excise Act.
3. The Petitioner being the admitted owner of the vehicle in which the contraband was transported, I do not see any merit in the challenge to quash the impugned order.
4. The CRLMC is dismissed.
5. However, it is open for the Petitioner to surrender before the learned S.D.J.M., Nilgiri and pray for bail. In such event, the prayer for bail of the Petitioner shall be considered in accordance with law.
