Heard learned counsel for the petitioners and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 06.09.2021 in connection with Belpada P.S. Case No.185 of 2021 corresponding to G.R. Case No.714 of 2021 pending in the Court of learned Addl. Sessions Judge, Patnagarh for the alleged commission of offence under Sections 274/275/120-B of IPC 4.

The allegation against the petitioner is that he was selling Eskuf cough syrup and Nitrosun tablets. Some of those cough syrups were found to be adulterated.

However, considering the fact that the quantity of codeine phosphate found in seized cough syrup bottles is less than commercial quantity, as also the fact that charge sheet has already been submitted and the petitioner has spent more than six months in custody by now, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to

impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
