1. During the pendency of the present appeal, no interim order has been passed by this Court staying the operation of the order of the learned Single Judge. By the impugned order, the Respondent No.1 was permitted by the learned Single Judge to clear up the backlog subjects and he was permitted to appear in those back subjects in the regular semester of the University. The said order must have worked itself out and therefore, by efflux of time, the appeal has become infructuous.

2. Leaving the questions of law open for decision in some other appropriate case, the appeal is disposed of.
