The petitioner in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") has prayed for quashing of the proceeding in Bhubaneswar Vigilance P.S. Case No.41 of 2012 corresponding to V.G.R. Case No.41 of 2012, pending on the file of the learned Special Judge, Vigilance, Bhubaneswar.

Heard the learned counsel for the petitioner and Mr. Pani, the learned Sr. Standing counsel appearing for the Vigilance Department.

It is stated by the learned counsel for the petitioner that this matter has become infructuous as per the instruction
// 2 // received from his client, inasmuch as it has ended with final report. However, he further submits that the petitioner may be permitted to withdraw this CRLMC with liberty to challenge the order of cognizance if passed in spite of the final report submitted.

In view of such submission, this CRLMC stands disposed of being withdrawn with liberty sought for. Interim order dated 29.08.2012 passed by this Court stands vacated. 6.
A copy of this order be communicated to the Court below forthwith.
