This matter is taken up through hybrid mode.

The Petitioners in this writ application seek to assail the order dated 17th December, 2010 (Annexure-5) passed by learned Civil Judge (Senior Division), Bhawanipatna in I.A. No.96 of 2010 (arising out of C.S. No.157 of 2010), whereby an application under Order XXXIX Rules 1 and 2 C.P.C. filed by the Opposite Parties has been allowed.

From the order sheet, it appears that notice could not be issued to the Opposite Parties due to non-filing of postal requisites. It also appears that no step is taken since 30th March, 2011 to get the matter listed.

In view of the above, it appears that the Petitioners have lost interest in pursuing the writ petition.
