This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioners with a prayer to quash the order taking cognizance dated 9th October, 2009 passed by the learned S.D.J.M., Jeypore in I.C.C. No.52 of 2009.

No one appears on behalf of the Petitioners at the time of call. The case is of the year 2011.

As such, the CRLMC is dismissed for non-prosecution. 5.

However, liberty is given to the Petitioners to raise all the contentions at the time of framing of charge, if charge has not been framed in this case and in that event, the court concerned shall consider the same in accordance with law.

Interim order dated 27th April, 2011 stands vacated. 7.

Order be communicated to the court concerned forthwith.
