1. There are two grounds on which the selection list dated 21st July, 2013 pursuant to an advertisement dated 27th April, 2013 for filling up Group-D posts in the Court of the Civil Judge, Balasore is assailed. One is that the reservation was more than 50%.

2. There is no rule rigid about the reservation not being more than 50%. Here of the 27 posts, 15 were reserved. The Court does not find any illegality which requires interference.

3. The second ground on which the impugned select list is challenged is that although there were only 27 posts, select list contains 47 names. It has been explained in the counter affidavit that the names below the 27th name were all wait listed.

4. In that view of the matter, there is no merit in the petition and it is dismissed as such.
