This matter involves an allegation in the matter of reservation of Constituency in absence of consideration to the objection of the Petitioner filed before the Competent Authority. The matter was taken up for fresh admission on 01.02.2022 and entertaining the Writ application, this Court directed the State Counsel to obtain instruction as to the outcome on the objection of the Petitioner vide Annexure-5. 2.
Today on his appearance, Mr. R.P.Mohapatra learned AGA requests for further time on the guise of non-receipt of any instruction in the meantime. This Court finds there is no purpose in keeping such Writ Petition pending as there may be necessity bringing further pleading and challenge to the outcome of the objection of the Petitioner in the meantime. In the process, this Court in disposal of the Writ Petition permits the Petitioner to refile in the event of there is any
// 2 // necessity and in the meantime, this Court also directs the State Authority to atleast communicate the outcome on the objection of the petitioner vide Annexure-5. Atleast within a period of three days from the date of communication of certified copy of this order by the Petitioner.
