It is submitted by Mr. Mohanty, learned senior counsel that he could not be able to get any instructions from the Appellant despite all efforts taken by him.

Accordingly the appeal is dismissed for non-prosecution. 4.

The statutory deposit made by the Appellant before the Registry of this Court along with accrued interest thereof be refunded on proper application.
