W.P.(C) No.6074 of 2006 Smt. Jema Dei (dead) through LR .... Petitioners Mr. L.K. Moharana, Advocate -versusThe Managing Committee, Sri Jagannath Temple, Puri and others .... Opposite Parties Mr. S. Satapathy, Advocate for Opposite Party Nos.1 to 3

CORAM:

THE CHIEF JUSTICE JUSTICE B. P. ROUTRAY

ORDER

16.05.2022 Order No.

20.

1. Counsel for the Petitioners informs the Court that the Opposite Party No.4 has expired.

2. Counsel appearing for Sri Jagannath Temple Administration states that this is the only shop that is left within the Anadabazar and it is in a dilapidated condition. Because of the status quo order that has been in force for 16 years now, nobody is in possession of the shop as well.

3. The Court sees no purpose being served in keeping an unoccupied shop in a dilapidated condition within the Anandabazar when all other shops have already been relocated.

4. Consequently, the interim order is vacated. The impugned order directing that the parties should resolve their inter se dispute in a civil court is reaffirmed.

5. The petition is dismissed.
