Heard learned counsel for the Parties.

Appearance memo filed on behalf of the counsel for the Petitioner in Court today be kept on record.

The Writ Petition involves two faceted challenges, one notice vide Annexure-4 appearing under Orissa Public Demands Recovery Act and other one is Annexure-5 appearing under the provision of Section 3(2) of Regulation-2 of 1956.

For the nature of notice, this Court finds there is ample opportunity to the Petitioner for his raising objections raised herein for the consideration of the authorities involved. Be that as it may this Court finds, in entertaining the Writ Petition, there is no grant of interim order. Learned counsel for the Petitioner is unable to inform the Court on the position involving notice vide Annexures-4 & 5 by way of further development.

The Writ Petition stands dismissed for counsel having no notice as no purpose will be solved finding Petitioner even did not get

// 2 // interim protection involving both the notice on entertainment of the Writ Petition since 2004.
