None appears for the petitioners when the matter is called. 3.

This writ application has been filed in the year 2001 with a prayer for directing the opp. party nos. 1 and 2 to accord approval for creation of additional posts and to regularize the services of the petitioners in Rajkishore Vidyapitha, Toral, Jagatpur. 4.

Mr. S.N. Mohapatra, learned Standing Counsel for School & Mass Education Department submits that the prayer of the petitioner has been considered during pendency of the writ application and rejected vide order dated 03.10.2002 and the said order has been annexed as Annexure-A to the show cause affidavit filed by Commissioner -cum- Secretary School and Mass Education Department.

Considering the above development, it is apparent that no relief can be granted to the petitioner unless the said order is challenged. As the writ application is pending since more than twenty one years, no useful purpose will be served by keeping it

pending.

The writ petition is accordingly dismissed granting liberty to the petitioner to challenge the order dated 03.10.2002, in case the same has not yet been challenged.

Urgent certified copy of this order be granted on proper application.
