This matter is taken up through hybrid arrangement Order No.

(virtual/physical mode).

Mr. P.R. Baik, learned counsel for the Appellants files a memo in Court today, which is taken on record. Pressing the memo, it is submitted by Mr. Barik that in the meantime the parties have accepted the position as per the compromise arrived at and accordingly, have filed an application before the Trial Court for passing the final decree in term of said compromise. He submits that the Trial Court even though has accepted the petition and has drawn the final decree, in view of the order of stay passed on 26.02.2008, the same has not been sealed and signed. He, therefore, prays for withdrawal of this Appeal.

Accepting the submission as above, the Appeal stands disposed of as withdrawn. It is needless to say that the interim order dated 26.02.2008 does no more survive to hold the field

// 2 // and the Trial Court is at liberty to seal and sign the final decree being drawn in terms of compromise as provided in law. Issue urgent certified copy as per rules.
