None appears for the Petitioner at the time of call. 3.

This RPFAM has been filed assailing the order dated 19th September, 2008 passed by learned Judge, Family Court, Cuttack in Criminal Proceeding No.193 of 2006, whereby an application filed by the Petitioner under Section 127 Cr.P.C. praying, inter alia, for alteration of judgment and order of maintenance dated 12th September, 2005 passed by the said Court in Criminal Proceeding No.136 of 1998, has been rejected.

It appears that vide order dated 12th February, 2008, notices to Opposite Parties was directed to be issued, but due to non-filing of requisites, notices could not be issued, as yet. In view of the above, this Court feels that the Petitioner has lost interest to pursue the RPFAM.
