None appears for the Petitioner at the time of call. 3.

Petitioner in this RPFAM seeks to assail the order dated 7th December, 2010 (Annexure-1) passed by learned Judge Family Court, Rourkela in Criminal Proceeding No.43 of 2006, whereby the Petitioner was directed to pay maintenance @ Rs.4,000/- per month to Opposite Parties (Rs.2,000/- each of the Opposite Parties) from the date of application under Section 125 Cr.P.C. 4.

This Court, vide order dated 21st January, 2011, while issuing notice in the matter, as an interim measure, directed that order dated 7th December, 2010 passed in Criminal Proceeding No.43 of 2006 by learned Judge, Family Court, Rourkela shall remain stayed for a period of six weeks subject to deposit of a sum of Rs.28,000/- within two weeks. It was further directed that the said amount should be released in favour of Opposite Partywife on proper application. Thereafter, the matter was adjourned

// 2 // on several occasions on the prayer of learned counsel for the Petitioner. It further appears that the interim order has not been extended.

In view of the above, it appears that the Petitioner has lost interest in pursuing the RPFAM. Accordingly, the RPFAM is dismissed for non-prosecution.
