This matter is taken up through video conferencing. Heard the learned counsel for the petitioners and learned counsel for the State.
This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioners in connection with Bhadrak Town P.S. Case No. 07 of 2022 corresponding to G.R. Case No.36 of 2022 pending in the Court of learned S.D.J.M., Bhadrak for the commission of the alleged offences punishable under sections 341, 323, 294, 336, 353, 332, 427,
// 2 // 506/34 of the Indian Penal Code, section 7 of the Criminal Law (Amendment) Ordinance, 1944, section 3 of P.P.P.D. Act and section 56 of the Disaster Management Act. It appears that during a demonstration, the public servants on duty have been assaulted and there are six criminal antecedents against petitioner no.1. In view of such materials available on record and the nature and gravity of accusation, while not inclining to grant anticipatory bail to the petitioners, it is observed that in the event the petitioners surrender and move for bail before the Court below within a period of four weeks, the learned Courts below shall dispose of the same expeditiously in accordance with law and the claim of parity with the co-accused persons, who are stated to have been released on bail, shall be taken into account. The case records shall be made available to the Court concerned for disposal of the bail application. The ABLAPL stands disposed of.
