Supdt.Of Post Office v. Sushil Padhan
IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P.(C) No.17632 of 2013 Superintendent of Post Offices, Sambalpur Division and others ....
Petitioners Mr. K.C. Kar, Advocate -versusSushil Pradhan and another ....
Opp. Parties
CORAM:
THE CHIEF JUSTICE JUSTICE R.K.PATTANAIK Order No.
ORDER
04.07.2022 06.
1. The challenge in the present petition is to an award dated 29th April, 2013 passed by the Permanent Lok Adalat for Public Utility Services, Sambalpur in PLA Case No.13 of 2012. It is seen that the PLA has passed an order requiring the Petitioners i.e. Superintendent of Posts, Sambalpur Division to pay a sum of Rs.50,000/- with 8% interest to the Opposite Party, which as it is, is an insubstantial amount. It is seen that this Court while directing notice to issue to the present petition on 16th September, 2013 stayed the operation of the impugned order subject to the Petitioners paying Rs.25,000/- to the Opposite Parties. That amount apparently has been paid. Since the amount involved is insubstantial and it seems unfair to drag the
// 2 // Opposite Parties into litigation over such a small amount, the Court is not inclined to interfere.
2. Accordingly, the writ petition is dismissed. (Dr. S. Muralidhar) Chief Justice (R.K. Pattanaik) Judge KC Bisoi
