CORAM:

JUSTICE BISWANATH RATH

ORDER

15.12.2022 Order No.

8.

1.

This writ petition is entertained only on the ground that in spite of several grounds agitated in the revision proceeding, the Revisional Authority while passing the impugned order at Annexure-3 did not discuss any of the grounds and simply disposes of the same saying he is agreeing with the submission of learned counsel for the opposite parties and not satisfied with the submission of learned counsel for the revisional petitioner furtehr he is agreeing with the observation of the lower authority. Such disposal is not known to the judicial history. 2.

In the circumstance, this Court interfering in the order at Anexure-3 remits the matter back to the revisional authority for re-exercise involving O.L.R. Revision Case No.2 of 2003. Since in spite of paper publication, nobody is appearing for the contesting opposite parties, on production of certified copy of this order by the petitioners appearing on their appearance before the Revisional Authority on 21.12.2022, the Revisional Authority shall do well in first noticing the opposite parties therein and then dispose of the revision afresh but, however, with reason order. 3.

The writ petition stands disposed of.
