This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order of cognizance dated 28th July, 2007 passed by the learned S.D.J.M., Panposh in I.C.C. Case No.404 of 2006.

It is stated that in the meanwhile, complainant has died. 4.

It is also stated that one of the Petitioner has died in the meanwhile.

In such view of the matter, this Criminal Misc. Case is disposed of giving liberty to the alive Petitioner to approach the trial court to drop the proceeding in view of the mandate of Section 256(1) of Cr.P.C. as the case is triable by summons procedure. (S. Pujahari) Judge DA
