This Writ Petition involves the following relief:- Order No.

"It is, therefore, prayed that this Hon'ble Court may be graciously pleased to admit this writ petition issue Rule Nisi in the nature of writ of MANDAMUS calling upon the Opp. Parties as to why they shall not be commanded to release the legitimate dues of the petitioner to the tune of Rs. 2,30,980/- with interest in respect of the supply of the construction materials as per bill under Annexure 3 ;

And if the Opp. Parties fails to show cause or show insufficient cause, the said rule be made absolute and the Opp.parties be commended to release the outstanding dues of Rs.2,30,380/- with interest in favour of the petitioner in respect of the supply of construction materials as per bill under Annexure- 3;

And / or pass any other order / orders as this Hon'ble Court deems just and proper ;"

Pursuant to issuance of notice on 30.04.2010, though a set of counsel have appeared on behalf of the authority-Opposite Party No.2, there is no filing of counter.

It is submitted by the learned counsel for Opposite Party No.2 that there is no finality to the claim of the Petitioner as of now. In this contingency this Court directs the Opposite Party No.2 to treat this writ

// 2 // petition as a representation at the instance of the Petitioner and take a lawful decision in the matter by completing the entire exercise within a period of one month from the date of communication of a certified copy of this order along with a copy of the writ petition by the Petitioner.
