This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order dated 6th February, 2012 passed by the learned J.M.F.C., Cuttack in I.C.C. No.1094 of 2009 wherein petition under Section 177 of Cr.P.C. filed by him has been rejected, as well as the entire proceeding taking note of the law in force.

Considering the facts and submissions made, this Court is not inclined to quash the order of cognizance as well as proceeding on the ground of lack of jurisdiction.

But, in view of the amendment, the learned J.M.F.C., Cuttack is directed to transfer the I.C.C. No.1094 of 2009 to the Court of S.D.J.M., Bhubaneswar, who shall on receipt of the same either try himself or transfer the case to the appropriate court dealing with such case and on receipt of the same, the Court concerned shall proceed from the stage where the case is now pending. Parties are directed to appear before the said court on 20th April, 2022.
