The Petitioner has a clear remedy for preservation of property and detention of the Parties even under the provision of Order 39 Rule 7 of C.P.C. In the circumstance, this Court is though not inclined to interfere with the impugned order but however observes, in the event the Petitioner files an Application under Order 39 Rule 7 of C.P.C., the same may be entertained and decided in accordance with law but however involving the parties concerned. Finality of Order 39 Rule-2A of C.P.C. Application, if pending, may also be attended to.

The CMP stands disposed of accordingly.
