Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with I.C.C. Case No.4467 of 2016 pending in the Court of learned S.D.J.M., Bhubaneswar for alleged commission of offences under sections 420/468/471/34 of the Indian Penal Code.
Perused the complaint petition.
This is a case arises out of a complaint petition in which summons have been issued to the petitioner. Since there is no apprehension of arrest of the petitioner, this anticipatory bail application is not
// 2 // maintainable. The petitioner is at liberty to appear before the learned Court below on receipt of the summons and move an application for bail, in the event of which the same shall be disposed of as expeditiously as possible by the Courts below in accordance with law.
The ABLAPL is accordingly disposed of.
