The petitioner in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") has challenged the order dated 31.01.2011 passed by the learned Addl. Sessions Judge, Balangir in Criminal Revision No.32/22 of 2008-2010 confirming the judgment dated 28.08.2008 passed by the learned J.M.F.C., Balangir in C.M.C. No.93 of 2007.

Learned counsel for both parties are present. 4.

Be that as it may, since the learned counsel appearing for the petitioner submits that he has no instruction in the matter, which is of the year 2011 and one decade has already

// 2 // been passed from the date of filing of this case, this Court is of the view that the petitioner appears to be recalcitrant litigant and has lost interest in the present litigation. Hence, this CRLMC stands dismissed for non-prosecution. Interim order dated 25.04.2011 passed by this Court stands vacated. 5.

A copy of this order be communicated to the Court below forthwith.
