1. The present application has been filed seeking restoration of O.J.C. No.12826 of 2000 which was dismissed for non-prosecution on 27th January, 2008. It may be noted that in the last 14 years, it has not even been listed once. The dispute being one of seniority clearly has been rendered infructuous due to passage of time.

2. Consequently, the Court is not inclined to interfere. The application is dismissed.
