01. 1. This matter is taken up through Virtual Mode.
2. The petitioner is an unsuccessful bidder in the tender process of long term query lease (five years) of Naladia Sand quarry (tender call Notice No.2463, dt.09/11/2021), and has laid challenge to the Memo order No.2807 dated 24.12.2021 passed by the Tahasildar, Mahakalapara as per Rule-27 (4)(iv) of OMMC Rules, 2016, whereby his bid has been rejected.
3. After arguing for some time and having failed to convince the Court, learned counsel for the petitioner prays for permission to withdraw the writ petition to enable his client to seek his alternative remedy under Rule 46 of the Odisha Minor Mineral Concession Rules, 2016.

4. The writ petition is accordingly dismissed as withdrawn with the aforesaid liberty.
5. As the restrictions due to resurgence of COVID19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020, modified by Notice No.4798, dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
