1. In the last 13 years despite notice having been issued even to a Order No.

fresh address of Opposite Party No.4 (Union), till date service has not been possible to be effected.

2. The challenge here is to the reference made to the Labour Court at the instance of Opposite Party No.4 (Union). If indeed they are unable to be traced for service of notice upon them, it is highly unlikely that they will pursue the reference before the Labour Court.

3. It may be noted here that while issuing notice in the first instance way back on 9th January, 2009 the Court has stayed further proceedings before the Tribunal. While now vacating the stay the Court permits the Petitioner, if at all the Opposite Party

No.4 (Union) appears in the Tribunal and seeks to proceed with the I. D. Case No.29 of 2008, to apply to this Court to revive this petition.

4. The writ petition is disposed of in the above terms.
