1. For the reasons stated therein, the delay of 40 days in filing the appeal is condoned. The application is allowed. W.A. No.331 of 2017
2. All that is happened by the impugned order of the learned Single Judge is that the matter has been remitted to the Sub-Collector to first decide the question of maintainability. This is hardly a case which gives rise to any issue that requires to be interfered with by this Court in the present writ appeal. Accordingly, the Court is disinclined to interfere with the impugned order of the learned Single Judge.
3. The writ appeal is accordingly dismissed.
