1. It appears that the loan borrowed by the Petitioner was for a tractor, but the tractor was meant to be used for transportation purposes and not agricultural purposes. As a result, the Petitioner could not avail up the facility of waiver of the agricultural loan as it was not for a purely agricultural purpose. The second difficulty as far as the Petitioner is concerned is that he is neither a "small farmer" nor a "marginal farmer", but falls under the category of "other farmer" i.e. having more than five acres of land.
2. On both these counts therefore the Petitioner would be entitled only to avail the one-time settlement and not the complete waiver. Consequently, the reliefs prayed for in the present petition cannot be granted. The writ petition is dismissed as such. (Dr. S. Muralidhar) Chief Justice (R.K. Pattanaik) Judge S.K. Guin
