Heard Mr.S.C.Puspalaka, learned counsel for the petitioner, Mr.S.K.Samal, learned Addl. Government Advocate for the State and Mr.Niranjan Panda, learned counsel representing opposite party No.3.

According to Mr. Puspalaka, the petitioner, who is a resident of Mahavir Nagar Basti, Bhubaneswar is aggrieved by inaction of the authorities in not extending her the benefits under Prime Minister Awas Yojana, though she is eligible for the same as per the terms and conditions of the Scheme. During course of hearing, he submits that liberty may be granted to the petitioner to approach the Bhubaneswar Municipal Corporation represented through the Commissioner (opposite party no.3) for redressal of her grievances and the said opposite party be directed to take a decision on such grievance petition within a specific time period and in the interregnum, interests of the petitioner be protected as otherwise she may be evicted.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioner to approach the Bhubaneswar Municipal Corporation represented through the Commissioner (opposite party no.3) by filing grievance petition along with the copy of this order through Registered Post within a period of ten days from today. In the event, such grievance petition is received by opposite party no.3, the said opposite party is directed to take a decision on the same in accordance with law within a period of three months from the date of receipt of such grievance petition and communicate the result of such exercise to the petitioner. Till disposal of such grievance petition, no coercive action shall be taken against the petitioner.
