This matter is taken up through Hybrid arrangement (video conferencing/physical mode). This is an application for modification of the order dated 01.02.2022.
Learned counsel for the petitioner submits that the petitioner could not surrender before the learned Court below as per the order dated 01.02.2022 due to his illness and therefore, the date of surrender may be extended. He further submitted that while disposing of the anticipatory bail application, direction has been given to the learned Court below instead of Courts below for consideration of the bail application of the petitioner.
Learned counsel for the State has no serious
// 2 // objection to such prayer.
Considering the submissions made by the learned counsel for the respective parties, the date of surrender of the petitioner is extended till 20th May 2022 and the bail application of the petitioner shall be considered by the learned Courts below in accordance with law.
With such modification, the rest part of the order dated 01.02.2022 remains unaltered.
The I.A. is accordingly disposed of.
