I.A. No.447 of 2022 11.

1. It is submitted by Mr. K.C. Nayak, learned counsel on behalf of Mr. H.K. Sarangi, learned counsel for the Appellants that though Appellant No.1-Rajendra Prasad Pattanaik, who is the father of the deceased died on 30.6.2020, but the same could not be brought on record of this Court inadvertently. It is further submitted that rest of the Appellants being the only surviving LRs of the deceased, no substitution is required and the enhanced compensation amount as directed by this Court be disbursed to those Appellants.

2. Upon hearing Mr. P.K. Panda, learned counsel for Respondent No.2-insurer and Mr. A. Sahu, learned counsel for Respondent No.1-owner and considering the submissions, it is directed that

the enhanced amount of Rs.3,50,000/- as per order dated 04.01.2022 of this Court be disbursed in favour of Appellant Nos.2, 3 and 4, namely, Kanak Manjari Pattanaik, Sarojini Mohanty and Adarsa Pattanaik respectively on such terms and proportion to be decided by the Tribunal.

3. The I.A. is disposed of.

4. An urgent certified copy of this order be granted on proper application.
