This matter is taken up through hybrid mode.

None appears for the petitioner when the matter is called. Learned counsel Mr. Das appeared on behalf of Opposite PartyCESU. 3.

The grievance of the petitioner relates to appear in the selection Test for appointment for the post of Assistant Manager (Electrical) in E-3 Grade conducted by the Opposite Party -CESU inter alia on the ground that they are qualified on the basis of degrees issued by Janardan Rai Nagar Rajasthan Vidyapeeth, Udaipur, Rajasthan.

Learned counsel, Mr. Das has placed on record the judgment passed by this Court dated 22.01.2014 in W.P.(C) No.4202 of 2009 Utkal Ranjan Mohanty and others V. Chairman, Distrance Education Council, Indira Ganfhi National Open University, Madam Qary,New Delhi and others wherein the

degrees granted by the said institute deemed to be a university under Section-3 of the UGC Act, 1956 was a matter of consideration. On going through the materials on record, this Court held that the said university is not competent to award degrees. 5.

In the light of the said judgment, the very basis of filing of this Writ Petition has been rendered infructuous and as such Writ Petition is dismissed being devoid of merit.
