This matter is taken up through hybrid mode.

This writ petition has been filed by the Petitioner seeking a direction to the Opposite Parties No.4 and 5 to publish the reciprocal transport agreement covering the routes lying between Orissa and Chhattisgarh including the route of Raipur to Rajkhariar under Section 88(6) of the Motor Vehicles Act, 1988 with further direction to the Opposite Parties No.1 and 2 to countersign the temporary stage carriage permits issued or to be issued by Opposite Party No.3 in favour of the Petitioner on the route of Raipur to Rajkhariar till the publication of reciprocal transport agreement under Section 88(6) of the Motor Vehicles Act, 1988 by the Opposite Parties No.4 and 5 and to hold and declare the action of the Opposite Parties No.1 and 2 in not countersigning the Petitioner's latest temporary permit as at Annexure-6 on the route of Raipur to Rajkhariar and back as unfair, improper and unreasonable in the circumstances of the case and to direct the said authorities

No one appears on behalf of the Petitioner at the time of call. However, Mr. Pravakar Behera, learned Standing Counsel appearing for the Transport Department is present.

The case is of the year 2005.

As such, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter.

Hence, this writ petition stands dismissed for nonprosecution. (S. Pujahari) Judge DA
