Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 09.12.2021 in connection with Junagarh P.S. Case No.424 of 2021 corresponding to C.T. Case No.112 of 2021 pending in the Court of learned Addl. Sessions Judge-cum- Special Court under POCSO Act, Bhawanipatna for the alleged commission of offence under Sections 376(2)(n)/376(3)/294/323/506/34 IPC read with Section 6 of POCSO Act.

It is alleged that the petitioner committed forcible sexual intercourse with the victim making her pregnant thereby. The statement of the victim recorded under Section 164 Cr.P.C. reveals that they have been staying together after birth of the child and the allegation relates to demand for dowry. 5.

Considering the submissions, materials on record and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such

terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
