Mr. Dash, learned advocate appears on behalf of petitioner and submits, his client's complaint to the police is regarding attempt to murder. The police did not accept his client's complaint. Procedure requires his client to post the complaint to the Superintendent of Police. He submits, to enable his client to send the complaint by post to the Superintendent of Police, this petition be dismissed as not pressed, with liberty to file afresh.

Mr. Panda, learned advocate, Additional Government Advocate appears on behalf of State. He submits, in event petitioner has cause of action after approaching the Superintendent of Police he will be entitled to seek remedy.

On record of above submission the CRLMP is dismissed with liberty to petitioner to apply afresh in event there is inaction after the complaint is delivered by post to the Superintendent of Police.
