1. This matter is taken up through Hybrid mode. Order No.

2. This application under Section 482 Cr.P.C. has been filed by the Petitioner for quashment of the order dated 18.08.2009 passed by the learned J.M.F.C., Khalikote in G.R. Case No.196 of 2008 wherein the learned J.M.F.C has taken cognizance under Sections 457/380/411/34 IPC against him.

3. It appears that this case is of the year 2011 and the defects pointed out by the S.R have not been removed yet.

4. None appears for the Petitioner, when the matter was called. The Petitioner is a recalcitrant litigant and does not want to proceed with the matter and has lost interest in the litigation.

5. Hence, this CRLMC stands dismissed for non-prosecution but liberty is given to the Petitioner to raise all the contentions at the time of framing of charge, if the charge has not been framed and the case is still pending.
