IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P (C) No. 15356 of 2017 State of Odisha & Ors.
.....
Petitioners Mr. A.K. Mishra, AGA Vs.
Bisikeshan Pradhan and Anr.
.....
Opposite Parties Mr. S.N. Patnaik, Adv.
CORAM:
DR. JUSTICE B.R. SARANGI MISS JUSTICE SAVITRI RATHO
ORDER
20.05.2022 Order No.
03.
This matter is taken up through hybrid mode.
2.
Heard Mr. A.K. Mishra, learned Additional Government Advocate for the State-petitioners.
3.
The State-petitioners have filed this writ petition seeking to quash the order dated 11.01.2016 passed by the State Administrative Tribunal, Odisha, Bhubaneswar in R.P. No. 72 of 2015 arising out of O.A. No. 737 of 2014.
4.
As it appears, though State Administrative Tribunal, Principal Bench, Bhubaneswar passed the impugned order on 11.01.2016, but the State-petitioners have preferred this writ petition on 27.07.2017, i.e., after lapse of more than one year, which shows that the State is not vigilant of its own conduct. 5.
Mr. A.K. Mishra, learned Additional Government Advocate prays that the matter may be disposed of on merit. 6.
Such a contention is rejected. This Court is not inclined to entertain this writ petition at this belated stage, as the writ petition suffers from delay and laches, in view of the judgment/order of
this Court in the case of State of Odisha v. Surama Manjari Das (W.P.(C) No. 15763 of 2021 dismissed on 16.07.2021). 7.
Accordingly, the writ petition merits no consideration and the same is hereby dismissed.
